Yes, but this gives them an out. There's no way Goodell wants to punish the Super Bowl Champs for cheating on the way to the Super Bowl. Much better from their perspective to sweep it under the rug "Oh, the evidence is missing".

Tedy Bruschi sitting there on ESPN bellyaching that the punishment wasn't severe enough is funny though. What a maroon!
